PAYMENTS

The following forms of payment are accepted by Dilmos Milano (Account Owner Berari Re SRL):

1. Credit card

At the time of purchase, customers enter their credit card details in a secure electronic banking system, provided by Mercury Payments.
You can make purchases through Visa, Mastercard, Maestro, Diners e JCB.

Credit card security

All transactions are processed through secure servers, ensuring the maximum data protection for Dilmos customers.
Dilmos customer service providers are in no way authorized to request or accept credit card numbers and/or end-of-validity.
In order to ensure greater protection on e-commerce purchases, Dilmos recommends that customers adhere to Verified By Visa or MasterCard Secure code services, requiring a PIN security code with which to make their purchases safely.

Credit card charges 

If the existing funds are sufficient to purchase and the bank details provided are valid, the transaction will be processed instantly. 
The credit card used will be debited at the time of purchase even in the event of pre-order although the shipment of these items is later in the season.  Note that custom clearance, import duties and local taxes are always excluded.

2. Bank transfer

The payment with bank transfer shall be credited to our bank account within 10 working days from the placement of the order. After that date the order will be considered as cancelled. Send us the operation reference code, which will univocally identify your transaction. The Products will be shipped only after the amount is credited to Dilmos bank account, according to stock availability. Bank fees are beared by the client.

- The ordered Products shall remain in the property of Dilmos until final and full payment of their price (in accordance with art. 1523 and following of the Italian Civil Code): Dilmos reserves the right to lay claim to the ordered products in case of non-payment.

3. New customers

We would like to remind our new customers that Dilmos can ask their bank to verify the transaction, even contacting the bank counterpart. Such verification may cause some delay in shipment of the order. 
Dilmos reserves the right to send the order to the address to which the payment slip was sent.

SHIPPINGS

1. Shipment of the order

Dilmos can ship to any address within the European Union and all over the World. 

In case of payment via bank transfer, Dilmos will process the order only after verifying the actual crediting on its bank account. Therefore, the bank processing time should be added to the delivery lead time indicated in the order summary.

In-stock items’ standard shipping is made by express couriers within 3 working days to destinations in Italy, within 7 working days in Europe, within 10 working days for other destinations in the world.

In case of bulky order and/or fragile products, the shipping is made by specialized couriers and the delivery time depends on size and destination of the order. 

A product not indicated as in-stock, with a 2-3 weeks availability time, will be in our logistics within a maximum of 3 weeks from the order confirmation. Once the product has been stocked in our warehouses, standard shipping time will be calculated with expected delivery within 2 working days for Italy, within 5 working days in Europe and within 6 working days for all other destinations in the world.

For out of stock products, waiting times don’t include days from August 1 to August 27, while for in stock products shipments occur regularly with the exception of the month of August and bank holidays. We always allow the pick-up from our gallery in Via San Marco , Milan.
Please note that Dilmos cannot deliver to mailboxes (P.O. Boxes). Note that custom clearance, import duties and local taxes are always excluded.

It is agreed that the delivery terms indicated are intended merely as indicative and not mandatory, given the ongoing Covid-19 health emergency.

2. Order delivery

Deliveries shall be made at the postal address provided by clients when performing the purchase procedure and recorded in the purchase order. Therefore, clients are responsible for the address provided. Sellers shall not be liable for any mistakes related to shipments or wrong delivery of products, due to mistaken or incomplete information provided by clients when filling in their purchase orders.

Unless otherwise specified, Dilmos’s shipping policy provides delivery to the client at street level. Dilmos does not deliver items in apartments nor provide product installation services.

When the client receives the delivery, he/she must write on the transportation documents “goods accepted with reserve” in the presence of the driver. If there is damage caused by the carrier that is not immediately visible, the client will thereby be able to open a complaint with the transportation firm. All orders are insured against theft and accidental damage caused by transportation from Spotti to your delivery address. Once the parcel has been delivered and you have signed for acceptance at the delivery address, the insurance cover ends. To ensure your purchases arrive intact and in perfect condition, we mandatorily require a signature for acceptance upon delivery. Damaged goods that have not been accepted with reserve won't be refunded. All customers who place an order establish a business relationship with dilmos.it and therefore undertake to accept the delivery of their parcel. If the parcel is not delivered due to customer-dependent causes (wrong address, always absent recipient, incorrect telephone number, etc.) or if the customer refuses delivery, the shipping costs and any customs charges will be deducted from reimbursement due to the customer’s negligence.

RIGHT OF WITHDRAWAL

In accordance with art. 52 of Legislative Decree No. 206 of September 6, 2005 (the "Code of Consumption"), you have the right to withdraw from the contract signed with Berari re SRL (the "seller" or "Dilmos Milano") without any penalty and without having to give any explanations, within 14 days from the day you have received the products purchased on dilmos.it.

In accordance with art. 54 of the consumer code, you can exercise the right of withdrawal from the contract providing your statement describing your decision to withdraw via certified email (PEC) to berarire@legalmail.it or via registered post to Berari Re srl Piazza San Marco 1 20121 Milano.

In accordance with art. 57 of the consumer code, once the contract has been withdrawn, the products to be returned must be delivered to the courier within fourteen (14) days from the date on which you informed the seller of your decision to withdraw from the contract.

As laid down by Italian Legislative Decree no. 206 dated 6/9/2005 and by Art.55 of the Consumer Code, the right of withdrawal provided by these terms of sale does not apply to tailor-made or clearly customized goods or those that, by their nature, cannot be re-shipped or risk deteriorating or altering rapidly. If the right of withdrawal is not applicable on the products on sale, the Site shall show the phrase "right of withdrawal not applicable" in the product data sheet, in the page of the purchase procedure or in the order confirmation sent via email. We kindly invite you to always check the presence of this phrase. Furthermore, please note that the costs for returning the goods are always charged to the consumer.

1. Conditions for exercising the right of withdrawal in accordance with art. 52 of the Consumer code

The right of withdrawal is intended to be exercised correctly if the following conditions are fully complied with:
a. The right of withdrawal must be correctly exercised within fourteen (14) days of receipt of the products following one of the above-mentioned modalities;
b. The products must not have been used;
c. The identification tag must still be attached to the products and constitutes an integral part of the asset (see article 5 below);
d. The products must be returned in their original packaging (if you want to return a kit, you must return all the items that compose it);
e. Returned products must be delivered to the forwarder within fourteen (14) days from the time you have informed the seller of your decision to withdraw from the contract;
f. The products must not be damaged.
If you have complied with all the conditions required, the seller, in accordance with art. 56 of the consumer code, will fully reimburse you the price of the products purchased. 

2. How to return the products to the seller

If you correctly exercise your right of withdrawal, you will receive an email message at the email address provided when registering. This email shall bear all the necessary instructions in order to return products: file number, how to label packages and where to send the packages.(or the contact numbers of a forwarding agent with whom you can arrange the pickup).

3. Verification of conformity of returned products

You will be contacted if your return cannot be accepted because it does not comply with the conditions set out in the previous paragraphs. In the event that your return is not in conformity with the conditions set out in points a), e) and f) of paragraph 1 above, or in the case of art. 59 of the consumer code, you can choose to have back the products purchased at your expense. In case you refuse this shipment, the seller reserves the right to retain the products and the amount corresponding to the purchase price of the products.

We also remind you that, according to art. 57, paragraph 2, of the consumer code, you will be responsible for decreased value of the products returned to the seller, resulting from the use of the products other than that necessary to ascertain its nature, characteristics and operation. Therefore, in the event that your return cannot be accepted because it does not comply with the conditions set out in (b), c) and (d) of paragraph 1 above, you may choose to accept the refund, which will be communicated to you by the seller, with the decreased value of the returned products, or to have back the products purchased at your expense. In this last case, if you refuse the shipment, the seller will have the right to retain the products and the amount indicated for the deduction of the reimbursement, due to the decreased value of the returned products.

The seller assumes no responsibility in the case of products returned by mistake or personal items forgotten in the parcels of products returned.

4. Time and method of reimbursement

After the seller has received your return and checked that all the requirements have been observed with, you will receive an email confirming acceptance of the return and Dilmos shall proceed with the full refund, that is, if there is a existence of a decreased value of the returned products, you will receive an e-mail in which you'll be notified the amount deducted as a deduction of the reimbursement and Dilmos proceeds to reimburse the due fee. Whatever the payment method you use among those available, the refund is activated by the seller as soon as possible, and in any case within fourteen (14) days from the date on which the seller became aware of the exercise of your right of withdrawal, once it has been verified that the withdrawal has occurred in accordance with the above conditions.
The actual time for the re-crediting or restitution of the sums paid by you for the purchase of the products depends on the methods of payment used:
-Purchase by credit/debit card: The refund time depends on the credit/debit card management company, but normally occurs within two statements. We remind you that the currency date of the re-credit is the same as the charge, so you will not suffer any loss in terms of bank interest;
In case of gift, the reimbursement of sums will be made towards the person who made the payment.

5. Products affected by defects or non-conformity

Without prejudice to the application of mandatory rules to protect the consumer, you can return a product because it suffers from vices or not conform to what ordered, informing the seller, within three (3) days from the day you received the products purchased on dilmos.it. For the method products are returned, check sections 1 and 2. Dilmos will verify the products you have returned because they suffer from vices or do not conform to what you ordered and will proceed with full refund, including shipping costs and expenses you have suffered to return the products to Dilmos. In the event that Dilmos notices no defect or lack of conformity in the returned products, you will be informed that your return will not be accepted and you can choose whether to receive back the products purchased. In case you refuse the shipment, Dilmos will be entitled to retain the products and the amount corresponding to the purchase price of the products, and reserves the right to claim the costs incurred.

6. Circumstances for changing products

In any case you will not have the option to change the products purchased with others.

7. Product Identification Tag

We kindly remind you that all products offered for sale by the seller are equipped with an identification tag, which is an integral part of the asset. We therefore remind you to try the product without removing the tag, because products will not be accepted deprived of tags.

8. Consumer Code

These conditions for exercising the right of withdrawal, forming an integral part of the general conditions of sale, are governed by the Italian law and in particular by the Consumer Code.

RETURNS

If, for any reason, you are not satisfied with your purchase, the items can be returned for refund within 14 days from the date of receipt of the order. The security tags, certificates and original labels must be intact and affixed to the product. Please see below terms and conditions for making a return.

1. Returns instructions  

Please follow rigorously the instructions of the procedure shown:
1) Send us your statement describing your decision to withdraw via certified email (PEC) to berarire@legalmail.it or via registered post to Berari Re srl Piazza San Marco 1 20121 Milano.
2) Once Dilmos has received your communication of withdrawal, the Customer Care will contact you via email to accept your request and to confirm the shipment.
3) You must ship the goods you wish to return within 14 days from the acceptance date of your withdrawal request by Dilmos. The goods shall be returned in perfect conditions, in their original packaging and together with all accessories. Even if the law in force does not oblige the buyer to purchase an insurance policy on the goods returned, when exercising the right to withdrawal, may we suggest that you acquire one. You must bear the direct cost of returning the goods and you are the sole responsible for the product during its shipment. 4) Upon receipt Dilmos will verify the integrity of the goods and the presence of all products together with all accessories including the original packaging. 
5) If you have complied with all the conditions required, Dilmos, in accordance with art. 56 of the consumer code, will send you a confirmation of the acceptance of your return and it will fully reimburse you the price of the products purchased. 
For orders paid by credit/debit card, the amount refunded will normally be available to customers in about 10 days and will still be visible on the next card statement. The timing may vary slightly according to the bank circuit of the used credit card.
We remind you that the currency date of the refund is the same as the charge, so you will not endure any loss in terms of bank interest.

2. Terms and conditions

The security tag, certificate and product label on the items you return must not be cut or damaged. The products must not have been altered and must not show any signs of use.
Returns must be shipped with the original bag or box of the product inside the package with which the goods have been received which must be well sealed with adhesive tape. In the absence of the above, the parcel can be sent along with another suitable packing for the shipment of the goods.
Each product must be returned with all labels and tags attached, and inclusive of all original packaging and accessories received with the order.

In the event that the you receive defective merchandise, or that errors occur in the shipments by Dilmos, you are invited to contact the customer service immediately by writing to info@dilmos.it. When you receive the delivery, you must write on the transportation documents “goods accepted with reserve” in the presence of the driver. Dilmos reserves the right to request photographic evidence before authorizing returns for defective goods and in taking care of the shipping costs for the returned goods to its premises.
Dilmos also reserves the right to refuse unauthorized returns, or otherwise not complying with all the conditions laid down for the return procedure.

In this case, the goods will be returned to the sender at the original shipping address.
For all aspects not specifically expressed, the European legislation for distance trading applies.
